Introduction
- Welcome to Catchlights (“we”, “our”, or “us”). These Terms & Conditions govern your use of our website, services, and participation in our classes, events, and performances. By using our website and enrolling in any of our services, you agree to be bound by these terms. Please read them carefully. These terms are governed by the laws of England and Wales.
1. Bookings, Enrolment & Payments
- 1.1 Class Enrolment: Enrolment for classes, courses, and performances must be completed via our website or by contacting our administrative team. Enrolment is confirmed upon full payment.
- 1.2 Recurring Payments: By enrolling in a course or membership, you authorise recurring payments for future classes or subscriptions. It is your responsibility to ensure sufficient funds are available. You may cancel these recurring payments by notifying us at least 7 days prior to the next payment due date.
- 1.3 Payment Processing & Overdue Payments: Payments are processed securely through Stripe. If any payment remains uncollected, Stripe will send you an email, and attempt to process the payment again up to 8 times, over the next 14 days. After 14 days, if your payment is still overdue, we reserve the right to suspend or cancel your enrolment without further notice.
- 1.4 Outstanding Balances: Any overdue balance may be referred to a debt collection agency, and you may be responsible for additional costs associated with the collection of the debt.
2. Refunds & Cancellations
- 2.1 Class Cancellations by Us: Catchlights reserves the right to cancel or reschedule classes, performances, or events due to unforeseen circumstances. In such cases, you will be offered either a rescheduled class, receive a credit towards your next invoice for recurring classes, or receive a refund for standalone classes.
- 2.2 Class Cancellations by You: To receive a refund, cancellations must be made at least 7 days prior to the start of the class or event. Cancellations made after this period are non-refundable. Cancellations for classes with a recurring payment structure will be processed in line with the terms governing article "1.2 Recurring Payments".
- 2.3 Refunds: Refunds will be processed within 5 - 10 business days after receiving your cancellation request or in the event of a class cancellation by us. We are not responsible for delays due to payment providers or banks.
- 2.3 Missed Classes: We do not offer refunds or make-up classes for missed sessions unless the class is cancelled or rescheduled by us.
3. Performance Terms
- 3.1 Participation in Performances: Some classes may require students to participate in performances. By enrolling, you agree to partake in related activities such as rehearsals and preparation.
- 3.2 Performance Schedules: Performance dates, times, and venues may change. Catchlights will notify you of any such changes as soon as possible.
4. Ticketed Events & Sales
- 4.1 Ticket Purchase: Tickets for Catchlights performances or events are available for purchase online through our website or designated ticket vendors.
- 4.2 Refund Policy for Tickets: Once purchased, tickets are non-refundable except in cases where the event is cancelled by us. We reserve the right to make changes to performance dates or venues and will provide notice as early as possible.
- 4.3 Resale & Transfer of Tickets: Tickets purchased for our events cannot be resold for profit or commercial gain. Any tickets found to be resold for such purposes may be invalidated.
5. Venue, Schedule & Staff Changes
- 5.1 Class Changes: We reserve the right to change the location, time, date, or duration of classes, performances, or events. We will notify you in advance of any changes.
- 5.2 Staff Changes: Teachers or staff assigned to classes may be changed at our discretion. We will provide notice where possible, but such changes do not entitle you to refunds.
- 5.3 Online Classes: In extreme circumstances (such as a pandemic or natural disaster), we reserve the right to transition in-person classes to an online format. No refunds will be provided for a change to online learning.
6. Right to Refuse Enrolment
- 6.1 Refusal of Enrolment: We reserve the right to refuse enrolment or participation in any class, performance, or event if we believe the student’s behaviour is disruptive, non-compliant with our policies, or otherwise unsuitable.
- 6.2 Termination of Enrolment: We may also terminate enrolment for repeated missed payments, behavioural issues, or inappropriate conduct by the student or their guardians.
7. Health & Safety
- 7.1 Health Declarations: By enrolling in our classes, you confirm that you (or your child) are physically fit to participate in the activities. Any relevant medical conditions must be disclosed to us during enrolment. If you have any pre-existing health conditions, please consult a healthcare professional before enrolling.
- 7.2 First Aid: By enrolling in our classes, you consent to Catchlights administering first aid or seeking emergency medical treatment for you or your child in case of injury or illness during a class or event. We will contact the provided emergency contact as soon as possible in such situations.
- 7.3 Emergency Contact & Medical Information: It is your responsibility to provide up-to-date emergency contact details and medical information. This information will be used solely for safety purposes and must be kept current throughout your enrolment. You must notify us immediately if any personal, medical, or emergency contact details change.
8. Media, Photography & Audio
- 8.1 Photography, Audio & Video Consent: By attending our classes, performances, or events, you consent to Catchlights photographing, recording, and filming you (or your child). This may include still photography, video recording, and audio recording.
- 8.2 Audience Photography & Audio Use: Audience members at performances or events may also be photographed, filmed, or recorded. By attending as an audience member, you consent to the use of these recordings for promotional and marketing purposes.
- 8.3 Use of Media: Catchlights reserves the right to use photographs, video footage, and audio recordings for promotional, marketing, and educational purposes, including on our website and social media platforms. You will not receive compensation for the use of such media.
- 8.4 Opting Out: If you do not wish to appear in any media, please notify us in writing prior to the start of the class, event, or performance, and we will endeavour to accommodate your request.
9. Liability & Insurance
- 9.1 General Liability: Catchlights is not liable for any personal injury, loss, or damage to property that occurs during classes, performances, or while on our premises, unless such injury is caused by our negligence. Catchlights is further not liable for any indirect, incidental, or consequential damages arising from your use of our services, or use of our website.
- 9.2 Insurance: We maintain appropriate public liability insurance for our operations. It is your responsibility to secure personal accident or health insurance, if necessary.
- 9.3 Force Majeure: We are not liable for any disruptions to our services caused by unforeseen circumstances such as extreme weather, natural disasters, pandemics, or other events beyond our control.
10. Personal Property
- 10.1 Responsibility for Belongings: Participants are responsible for their personal belongings. Catchlights is not liable for any loss, theft, or damage to personal property brought onto our premises.
11. Children’s Safety & Pick-Up Policy
- 11.1 Pick-Up & Drop-Off Times: Parents/guardians must ensure that children are dropped off and picked up from classes and events on time. If a parent/guardian is late to collect their child, additional fees may apply, or the child may be supervised at an additional cost.
- 11.2 Leaving Unaccompanied: For older children or teenagers, you may grant permission for them to leave the premises unaccompanied. This must be provided in writing before the start of the term or class. If no such permission is given, we will not allow the student to leave without a responsible adult.
- 11.3 Emergency Situations: In case of any emergency or unexpected delay in pick-up, parents/guardians must contact us immediately. We will use emergency contact information provided during enrolment if we cannot reach a parent or guardian.
12. Use of Personal Information
- 12.1 Data Collection & Use: We collect personal information, including your name, contact information, payment details, and medical/emergency contact information, to process your enrolment, ensure the safety of participants, and for communication purposes.
- 12.2 Data Security: Your personal data will be stored securely and in compliance with the Data Protection Act 2018 and the UK GDPR. We will not share your personal data with third parties except as necessary for the processing of payments or legal obligations.
- 12.3 Marketing Communications: By enrolling in our classes, you agree to receive communications regarding class updates, new programs, and special offers. You can opt out of marketing communications at any time by following the instructions provided in the communications.
- 12.4 Updating Information: It is your responsibility to keep your personal, medical, and emergency contact information up to date. You must notify us promptly if any of your details change during your enrolment.
13. Social Media Use
- 13.1 Student Conduct: When engaging with Catchlights on social media platforms, we expect students and parents to maintain respectful conduct. Harassment, bullying, or discriminatory language will not be tolerated.
- 13.2 Content Sharing: Students and parents are encouraged to share their experiences on social media, but all content must be lawful, respectful, and not infringe on the privacy rights of others. Any misuse of social media may result in the termination of your enrollment.
14. Changes to Terms & Conditions
- 14.1 Right to Amend: Catchlights reserves the right to update or modify these Terms & Conditions at any time. Any changes will be posted on our website and will take effect immediately. Continued use of our services constitutes acceptance of any updated terms.
15. Governing Law
- These Terms & Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of England and Wales.
